Copyright Complaints

JEXP respects the intellectual property of others. It is JEXP’s policy to respond expeditiously to claims of copyright and other intellectual property infringement. We will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws. Arbitration and Jurisdiction

This agreement shall be governed solely by the laws of the State of Israel, without giving effect to any conflicts of law principles.

Any dispute which may arise between the parties, including disputes concerning usage of Jexp and/or concerning these Terms of Use, as well as the specific online agreements relating to certain services on Jexp, shall be brought before an arbitrator who is an attorney proficient in the field of electronic commerce and Internet, and whose identity shall be determined by the President of the Israel Bar at the request of any of the parties.

The arbitrator shall be entitled to grant provisional remedies and interim orders. The arbitration shall take place in the city of Tel Aviv. The arbitrator shall not be bound by the rules of civil procedure but shall be bound by the law of evidence and substantive law. The arbitrator shall give reasons for his decision. Notwithstanding the aforesaid, should any of the parties to this agreement be sued by a third party, in any legal proceeding whatsoever, the defendant, notwithstanding the aforesaid, may implied the other party to this agreement in such judicial process, and in such event this arbitration agreement shall not apply. The competent court for purposes of the Arbitration Law, 5728-1968, shall be the courts located in the city of Tel Aviv. This section constitutes an arbitration agreement between the parties for all intents and purposes. Subject to and without derogating from the aforesaid, in any matter that does not fall within the jurisdiction of the arbitrator, or any matter in which this arbitration agreement does not apply, for any reason whatsoever, exclusive jurisdiction shall lie with the competent court in the Tel Aviv District and the Central District in Israel.
